WINDSTAR CRUISE INJURY LAWYERS
Injured on a Windstar cruise?
Windstar sails small yachts, from sailing ships with tall sails to all-suite motor yachts, into small harbors that larger ships cannot reach. That means more tender and landing-craft transfers, more shore excursions and water activities, and often long distances from a hospital. If you were hurt, your Windstar ticket can decide where and how fast you have to act.

ABOUT WINDSTAR
Who you would be making a claim against.
Windstar Cruises was founded in 1984 and is owned by Xanterra Travel Collection. The line is based in Miami, Florida. Like any cruise operator, it has insurers and in-house lawyers, so what you tell them early can affect your claim.
THE FLEET
Seven yachts, from about 150 to about 350 guests.
Each yacht links to its own page with reported incidents, so passengers searching by ship name land here.
COMMON WINDSTAR CLAIMS
Where small-yacht cruising goes wrong.
Tender and landing injuries
Small-harbor calls mean frequent tender and landing-craft transfers.
Shore excursions
Tours and hikes sold through the line, often in remote places.
Water activities
Kayaking, snorkeling and swimming from the ship, and near-drownings.
Slip and fall
Wet teak decks, steep stairs and open upper decks.
Medical negligence
Limited onboard care and delayed evacuation from remote places.
Illness outbreaks
Norovirus and food- or water-borne illness on board.
WHAT TO DO AFTER AN INCIDENT
Report it onboard
Ask for a copy of the incident report before you leave the ship.
Document the scene
Photograph the hazard, the location, and any posted signage or lack of it.
Get seen onboard
A visit to the ship’s medical center creates a record with the date and time. Keep every bill and receipt.
Call before you settle anything
What you tell Windstar or its insurers early can affect your claim later, so do not sign a release or accept a payment before you call.

WINDSTAR-SPECIFIC QUESTIONS
How long do I have to file a claim against Windstar?
Windstar’s ticket contract, like most, can set a short deadline and name the court you must use. Most cruise tickets give you one year to file, and often six months to give written notice. Because the exact terms depend on your ticket, we check the contract that applies to you.
I was hurt boarding a tender or landing craft, does that count?
It can. Boarding a tender or landing craft in open water is a common source of injury claims at small harbors where a ship cannot dock, and the same ticket-contract deadlines apply. Whether you have a claim depends on what went wrong, such as the sea conditions, the crew’s help or the equipment.
What if the excursion was sold through Windstar?
Excursions sold through the cruise line can carry different responsibility than ones you booked on your own ashore. For that reason, it is a key early question in any shore-excursion claim, especially for tours in remote places run by outside operators.
I was hurt kayaking, snorkeling or swimming from the ship. What should I do?
Get medical care first, then report it and keep your records. The cruise line may be responsible for activities it offers from the ship, although a waiver you signed does not always end a claim. Because the details matter, please keep a copy of anything you signed.
What if I needed medical care on a small yacht far from a hospital?
Limited onboard care, or a delay in getting you to a hospital, can be part of a claim. Small ships often have small medical teams and sail far from help, so how quickly the crew acted and called for help can matter. Please keep every medical record and write down the times.
What does it cost to find out if I have a case?
Nothing. The review is free, and if we take your case, we work on contingency, so our fee comes only from what we recover for you.
